I. About web/mobile application

HolaMed Healthcare Technologies Private Ltd. (“us”, “we”, or “HolaMed ”) is the author and publisher of the internet resource (“Website”) and the Android Application on the world wide web and the android playstore as well as the software, applications and other services provided by HolaMed Healthcare Technologies Private Ltd (together, “Services”). This Privacy Policy sets out how we collect, use, share and otherwise deal with your personal information and sensitive personal data or information (together, “Information”). By accessing and/or using any part of our Services (including visiting the Website) you accept this Privacy Policy, in addition to any terms of use that may apply with respect to the Services (“Terms of Use”), and expressly give your consent to our collecting, using and sharing of Your Information (defined below) in accordance with this Privacy Policy.

If you are a service provider such as a doctor, clinic, hospital or other such party and we have agreed with you specific privacy related obligations, then those shall prevail to the extent of a conflict between those provisions and this Privacy Policy. If you use the Services in different capacities – e.g. as a patient as well as a doctor – then the respective Privacy Policy or terms will apply to you in the relevant capacity in which you are acting. Collection of Information Information you provide to us We collect Information you provide directly to us or enable or permit us to collect in the course of accessing and/or using any part of the Services (together, “Your Information”). Your Information may, without limitation, include (but is not limited to) the following: Contact data (such as your email address and phone number); Demographic data (such as your location, gender, your date of birth and your pin code); Your health related information including medical records and history; physical, physiological and mental health condition; sexual orientation; biometric information; financial information such as bank accounts, credit and debit card details or other payment instrument details; Data regarding your usage of the Services and history of the appointments made by or with you through the use of Services; Insurance data (such as your insurance carrier and insurance plan); and Other Information that you voluntarily choose to provide to us (such as information shared by you with us through emails or letters. Information we collect from other sources We may also receive information from other sources and combine that with information we collect through our Services. For example: If you choose to link, create, or log in to your HolaMed account with a social media service (e.g., Facebook), or if you engage with a separate app or website that uses our API (or whose API we use), we may receive information about you or your connections from that site or app. Information you provide or enable collection through apps or other software features We may also seek permission for our app’s collection and syncing of contact information from your communications device in accordance with the permission system used by your mobile operating system. You may alter or disable the collection and syncing of Your Information where your mobile operating system enables you to alter the settings for such collection and syncing, but at all times subject to the condition that where our Services depend on the availability to us of such Your Information, then the Services may not be available to you where we do not have access to such of Your Information. Important information about platform permissions Most mobile platforms (iOS, Android, etc.) have defined certain types of device data that apps cannot access without your consent. And these platforms have different permission systems for obtaining your consent. For example, the iOS platform will alert you the first time the HolaMed app wants permission to access certain types of data and will let you consent (or not consent) to that request; Android devices will notify you of the permissions that the HolaMed app seeks before you first use the app, and your use of the app constitutes your consent. Use of Information We may use Your Information to do any of the following (and you acknowledge these may be for our commercial use): As necessary or expedient to provide, maintain, and improve our Services to you. This includes, without limitation, facilitating communications between or among: (i) you and service providers you connect with using the Services (or otherwise) and/or potential service providers in relation your availing of their services; (ii) you and other actual or potential Users of the Services and/or actual or potential Users of the service providers. We may also obtain or collect feedback about the Services and your use of the Services (all such feedback may be used by us in accordance with this Privacy Policy); Perform internal operations and activities including, without limitation, to provide support to the Services; respond to errors or problems with the Services; monitoring, performing analysis and research on Your Information and your and/or others’ activity with respect to use of the Services; business intelligence purposes; Provide recommendations, communications, advertisements, referrals or content to you regarding features of the Services; Connect with you or recommend to you information, resources or connections in the social media platform(s); Sell or transfer any data, analysis, business intelligence and research to any third party – to the extent practicable in an aggregated or non-personally identifiable form; Send communications to you as are necessary for the provision of the Services (including administrative messages); Send marketing communications, promotional messages, news and information to you with regard to the current, past or future Services and/or services of our affiliates and other third parties. Certain Services may, subject to applicable telecommunications regulations, permit you to connect with a service provider via the telecommunications network (e.g. via voice, Internet or data). Where you avail of such Services, we may maintain a record of your communications with us or any service provider. These records may be used by us for all purposes set out in this Privacy Policy. In the course of using the Services, it may be necessary for you to make payments using credit cards or other electronic or Internet based payment modes. We may collect such of your credit card number and/or other financial institution information such as bank account numbers and will use that information for the billing and payment processes, including but not limited to the use and disclosure of such credit card number and information to third parties as necessary to complete such billing operation. Verification of credit information, however, is accomplished solely by the User through the authentication process. User’s credit-card/debit card details are transacted upon secure sites of approved payment gateways which are digitally under encryption, thereby providing the highest possible degree of care as per current technology. However, HolaMed will provide you an option not to save your payment details. User is advised, however, that internet technology is not full proof safe and User should exercise discretion on using the same Sharing of information Through our services We may share your Information: with service providers whose services you avail of through the Website. For example, we share visitor's name and contact you provide while booking appointments; with third parties to provide you a service you requested through a partnership or promotional offering made by a third party or us; with the general public if you submit content in a public forum, such as blog comments, social media posts, or other features of our Services that are viewable by the general public; with third parties with whom you choose to let us share Information, for example other apps or websites that integrate with our Application Programme Interface (“API”) or Services, or those with an API or service with which we integrate. Other important sharing We may share your Information: With HolaMed’s affiliated entities that provide services or conduct data processing on our behalf, or for data centralization and / or logistics purposes; With vendors, consultants, marketing partners, and other service providers who need access to such information to carry out work on our behalf; In response to a request for Information by a competent authority if we believe disclosure is in accordance with, or is otherwise required by, any applicable law, regulation, or legal process; With law enforcement officials, government authorities, or other third parties if we believe your actions are inconsistent with our User agreements, Terms of Service, or policies, or to protect the rights, property, or safety of HolaMed or others; In connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company; If we otherwise notify you and you consent to the sharing; and In an aggregated and/or anonymized form which cannot reasonably be used to identify you. Social Sharing Features The Services may integrate with social sharing features and other related tools which let you share actions you take on our Services with other apps, sites, or media, and vice versa. Your use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the social sharing service. Please refer to the privacy policies of those social sharing services for more information about how they handle the data you provide to or share through them. Storage and Transfer of Your Information We may transfer the information described in this Statement to, and process and store it in, India or outside India. Where this is the case, we will take appropriate measures to protect Your Information in accordance with this Privacy Policy. HolaMed will take all reasonable endeavours to comply with your requests regarding access, correction, and/or deletion of Your Information. However, you acknowledge that any deletion shall be subject to your consents and permissions set out in this Privacy Policy. HolaMed neither makes any warranties or representations regarding the services of those third parties nor control or endorse those services or the content, messages or information found in those services. HolaMed expressly disclaims any liability with regard to: (a) your access and/or use of; (b) any decisions made with regard to; (c) any actions that you may take with regard to; the Services or any third party services. You may choose to unsubscribe from marketing and promotional communications that you may receive from HolaMed by clicking the relevant ‘unsubscribe’ link(s) provided as a part of such promotional marketing or communications. You may cancel your account or otherwise stop using the Services. If you do that, you acknowledge that: (a) we may retain Your Information for so long as it is necessary to comply with law and/or regulation or in accordance with our reasonable business practices; and (b) it may not be possible for us to delete Your Information from every database that it may form a part of. Where practicable, after a period of time, Your Information may be anonymized and aggregated, and then we may continue to use it as long as we consider necessary. We are not liable for any actions or steps taken by such third party web sites and Your Information accessed, collected or used by these parties. \Cookies and advertising Due to the communications standards on the Internet, when a User or the End-User or anyone who visits the Website, HolaMed automatically receives the URL of the site from which anyone visits. HolaMed also receives the Internet Protocol (IP) address of each User’s computer (or the proxy server a User used to access the World Wide Web), User’s computer operating system and type of web browser the User is using, email patterns, as well as the name of User’s ISP. This information is used to analyze overall trends to help HolaMed improve its Service. The linkage between User’s IP address and User’s personally identifiable information is not shared with third parties. Notwithstanding the above, HolaMed may share some of the aggregate findings (not the specific data) in anonymized form (i.e., non-personally identifiable) with advertisers, sponsors, investors, strategic partners, and others in order to help grow its business. The Website uses temporary cookies to store certain data (that is not sensitive personal data or information) that is used by HolaMed and its service providers for the technical administration of the Website, research and development, and for User administration. Security practices and procedures and other terms HolaMed implements reasonable security practices and procedures which are implemented by HolaMed include but are not limited to: encrypting data when it is on the move using industry standard practices, keeping all the data within private cloud, regularly changing production keys and password, secure and very limited access to all production servers, performing regular security updates on our servers and more. No administrator at HolaMed will have knowledge of your password. It is your responsibility to protect from unauthorized access and use your log in and password information and any such log in credentials with regard to the Services and use reasonable security measures that are available to you through your communications device and system. HolaMed is not liable for any unauthorized access or use of your account and password or any consequences of such unauthorized access or use. If you suspect any unauthorized use of your account, you must immediately notify HolaMed by sending an email to . You indemnify HolaMed for any loss, costs, damages, expenses or claims incurred or suffered by it due to any unauthorized use of your account and password. Notwithstanding the above, HolaMed is not responsible for the confidentiality, security or distribution of your personal information by our partners and third parties outside the scope of our agreement with such partners and third parties. Further, HolaMed shall not be responsible for any breach of security or for any actions of any third parties or events that are beyond the reasonable control of HolaMed including, acts of government, computer hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption, poor quality of Internet service or telephone service of the User, etc. Changes to Privacy Policy HolaMed may update this Privacy Policy at any time, with or without advance notice. In the event there are significant changes in the way HolaMed treats Your Information, or to the Privacy Policy itself, HolaMed may send Users an email, as provided for above, so that you may review the changed terms prior to continuing to use the Services. As always, if you object to any of the changes to our terms, and you no longer wish to use the Services, you may contact to deactivate your account.
